Research on the influence of industry on chemical regulation has mostly been conducted within the framework of the production of ignorance. This special issue extends this research by looking at how industry asserts its interests––not just in the scientific sphere but also at other stages of policy-making and regulatory process––with a specific focus on the types of tools or instruments industry has used. Bringing together sociologists and historians specialized in Science and Technology Studies, the articles of the special issue study (...) the arenas in which instruments and practical guidelines for public policy are negotiated or used. The aim is to observe the devices in the making or in action, from the selection of actors to the production of thresholds, criteria, and other technical regulations. The introduction highlights how industry influence on expertise and regulation is undoubtedly far more pervasive and multifarious than has been conceptualized to date by social scientists. Putting this issue back at the heart of both the STS and social sciences research agendas is increasingly urgent and could lead to new inquiries able to highlight these logics even more widely, using fresh empirical examples. Recently, Luk tried to establish a model and a theory of scientific studies. He focused on articulating the theory and the model, but he did not emphasize relating them to some issues in philosophy of science. In addition, they might explain some of the issues in philosophy of science, but such explanation is not articulated in his papers. This paper explores the implications and extensions of Luk’s work in philosophy of science or science in general.

As the implementation of new approaches and procedures of medical ethics is as complex and resource-consuming as in other fields, strategies and activities must be carefully planned to use the available means and funds responsibly. Which facilitators and barriers influence the implementation of a medical ethics decision-making model in daily routine? Up to now, there has been little examination of these factors in this field. A medical ethics decision-making model called METAP was introduced on three intensive care units and two (...) geriatric wards. An evaluation study was performed from 7 months after deployment of the project until two and a half years. Quantitative and qualitative methods including a questionnaire, semi-structured face-to-face and group-interviews were used. Sixty-three participants from different professional groups took part in 33 face-to-face and 9 group interviews, and 122 questionnaires could be analysed. The facilitating factors most frequently mentioned were: acceptance and presence of the model, support given by the medical and nursing management, an existing or developing ethics culture, perception of a need for a medical ethics decision-making model, and engaged staff members. Lack of presence and acceptance, insufficient time resources and staff, poor inter-professional collaboration, absence of ethical competence, and not recognizing ethical problems were identified as inhibiting the implementation of the METAP model. However, the results of the questionnaire as well as of explicit inquiry showed that the respondents stated to have had enough time and staff available to use METAP if necessary. Facilitators and barriers of the implementation of a medical ethics decision-making model are quite similar to that of medical guidelines. The planning for implementing an ethics model or guideline can, therefore, benefit from the extensive literature and experience concerning the implementation of medical guidelines. Lack of time and staff can be overcome when people are convinced that the benefits justify the effort. (shrink)

Causal pre-emption scenarios are problematic for the counterfactual framework of causation (CFC) because people judge an action to be the actual cause of an outcome although the outcome would have occurred anyway due to the action of a pre-empted alternative cause. We propose that commonsense causal questions typically probe specific events that actually happened as and how they did, and show that counterfactuals that probe specific events match selections of actual cause, and dissociations only occur with non-specific counterfactuals. In addition, (...) the pre-empted action is often selected as the or an actual cause when it causes the pre-empting action (auto-pre-emption). Judgements of an action’s responsibility for the outcome track judgements of actual cause following the legal sine qua non principle. Agent reproach is also influenced by the agent's intention. The effects of causal dependency structure and counterfactual question type are robust across the intentionality of the pre-empting action and scenario content. (shrink)

The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

ObjectiveTo investigate the association of pre-existing migraine in patients hospitalised and who recovered from severe acute respiratory syndrome coronavirus 2 infection with the presence of post-coronavirus disease symptoms.BackgroundNo study has investigated the role of migraine as a risk factor for development of post-COVID symptoms.MethodsA case-control study including individuals hospitalised during the first wave of the pandemic was conducted. Patients with confirmed previous diagnosis of migraine were considered cases. Two age- and sex-matched individuals without a history of headache per case were (...) also recruited as controls. Hospitalisation/clinical data were collected from hospital medical records. Patients were scheduled for a telephone interview. A list of post-COVID symptoms was systematically evaluated, but participants were invited to freely report any symptom. The Hospital Anxiety and Depression Scale and the Pittsburgh Sleep Quality Index were used to assess anxiety/depressive symptoms and sleep quality. Multivariable conditional logistic regression models were constructed.ResultsOverall, 57 patients with confirmed diagnosis of migraine and 144 non-migraine controls who had recovered from COVID-19 were assessed at 7.3 months after hospital discharge. The number of post-COVID symptoms in the migraine group was significantly greater than in the non-migraine group. Fatigue was significantly more prevalent in the migraine group. However, no between-groups difference in the prevalence of headache as a post-COVID symptom was detected.ConclusionPatients with a history of migraine who recovered from COVID-19 exhibited more long-term fatigue as post-COVID sequelae than those without migraine. Some of the pathophysiological changes associated with migraine could predispose to the occurrence of post-COVID symptoms. (shrink)

The human brain’s ongoing activity is characterized by intrinsic networks of coherent fluctuations, measured for example with correlated functional magnetic resonance imaging signals. So far, however, the brain processes underlying this ongoing blood oxygenation level dependent (BOLD) signal orchestration and their direct relevance for human behavior are not sufficiently understood. In this study, we address the question of whether and how ongoing BOLD activity within intrinsic occipital networks impacts on conscious visual perception. To this end, backwardly masked targets were presented (...) in participants’ left visual field only, leaving the ipsi-lateral occipital areas entirely free from direct effects of task throughout the experiment. Signal time courses of ipsi-lateral BOLD fluctuations in visual areas V1 and V2 were then used as proxies for the ongoing contra-lateral BOLD activity within the bilateral networks. Magnitude and phase of these fluctuations were compared in trials with and without conscious visual perception, operationalized by means of subjective confidence ratings. Our results show that ipsilateral BOLD magnitudes in V1 were significantly higher at times of peak response when the target was perceived consciously. A significant difference between conscious and non-conscious perception with regard to the pre-target phase of an intrinsic-frequency regime suggests that ongoing V1 fluctuations exert a decisive impact on the access to consciousness already before stimulation. Both effects were absent in V2. These results thus support the notion that ongoing slow BOLD activity within intrinsic networks covering V1 represents localized processes that modulate the degree of readiness for the emergence of visual consciousness. We critically address current theories of figurative language, focusing on the role of literal or compositional meaning in the interpretation of non-literal expressions, including idioms and metaphors. Specifically, we formulate and discuss the processing hypothesis that compositional meaning may either facilitate or impede the recovery or construction of the intended figurative meaning depending on multiple factors, and in particular, on the expression’s decomposability and on the “strength” of semantic relations between the compositional and figurative meanings. As a case study, we (...) consider research on processing and acquisition of figurative expressions in highly verbal individuals with autism spectrum disorder in comparison to neuro-typical individuals, and examine the factors that may account for the observed comprehension deficits in the ASD group. Based on this evidence, we discuss some of the strategies employed by language users in processing non-compositional or non-literal expressions, and we highlight implications for research on natural language comprehension and processing systems in the domain of figurative meaning. With the outbreak of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), global researchers were confronted with major challenges. The German National Pandemic Cohort Network (NAPKON) was launched in fall 2020 to effectively leverage resources and bundle research activities in the fight against the coronavirus disease 2019 (COVID-19) pandemic. We analyzed the setup phase of NAPKON as an example for multicenter studies in Germany, highlighting challenges and optimization potential in connecting 59 university and nonuniversity study sites. We examined the ethics application (...) process of 121 ethics submissions considering durations, annotations, and outcomes. Study site activation and recruitment processes were investigated and related to the incidence of SARS-CoV-2 infections. For all initial ethics applications, the median time to a positive ethics vote was less than two weeks and 30 of these study sites (65%) joined NAPKON within less than three weeks each. Electronic instead of postal ethics submission (9.5 days (Q1: 5.75, Q3: 17) vs. 14 days (Q1: 11, Q3: 26), p value = 0.01) and adoption of the primary ethics vote significantly accelerated the ethics application process. Each study center enrolled a median of 37 patients during the 14-month observation period, with large differences depending on the health sector. We found a positive correlation between recruitment performance and COVID-19 incidence as well as hospitalization incidence. Our analysis highlighted the challenges and opportunities of the federated system in Germany. Digital ethics application tools, adoption of a primary ethics vote and standardized formal requirements lead to harmonized and thus faster study initiation processes during a pandemic. (shrink)

This paper investigates formal logics for reasoning about determinacy and independence. Propositional Dependence Logic D and Propositional Independence Logic I are recently developed logical systems, based on team semantics, that provide a framework for such reasoning tasks. We introduce two new logics L_D and L_I, based on Kripke semantics, and propose them as alternatives for D and I, respectively. We analyse the relative expressive powers of these four logics and discuss the way these systems relate to natural language. A crucial aspect of scientific realism is what do we mean by true. In Luk’s theory and model of scientific study, a theory can be believed to be “true” but a model is only accurate. Therefore, what do we mean by a “true” theory in scientific realism? Here, we focus on exploring the notion of truth by some thought experiments and we come up with the idea that truth is related to what we mean by the same. This has repercussion (...) to the repeatability of the experiments and the predictive power of scientific knowledge. Apart from sameness, we also found that truth is related to the granularity of the observation, the limit of detection, the distinguishability of the objects in theory, the simultaneous measurements of objects/processes, the consistencies of the theory and the one-to-one correspondence between terms/events and objects/processes, respectively. While there is no guarantee that we can arrive at the final “true” theory, we have a process/procedure with more and more experiments together with our own ingenuity, to direct us towards such a “true” theory. For quantum mechanics, since a particle is also regarded as a wave, quantum mechanics cannot be considered as a true theory based on the correspondence theory of truth. Failing this, truth may be defined by the coherence theory of truth which is similar to the coherence of beliefs. However, quantum mechanics may not be believed to be a true theory based on the coherence theory of truth because wave properties and particle properties may contradict. Further research is needed to address this problem if we want to regard quantum mechanics as a “true” theory. (shrink)

This paper argues that scientific studies distinguish themselves from other studies by a combination of their processes, their (knowledge) elements and the roles of these elements. This is supported by constructing a process model. An illustrative example based on Newtonian mechanics shows how scientific knowledge is structured according to the process model. To distinguish scientific studies from research and scientific research, two additional process models are built for such processes. We apply these process models: (1) to argue that scientific progress (...) should emphasize both the process of change and the content of change; (2) to chart the major stages of scientific study development; and (3) to define “science”. St. Thomas Aquinas envisaged theology to be a kind of scientia which was considered as a kind of first cause science. However, science of that time is different from “modern” science. Recently, a theory of scientific study is developed, which outlines science by a theory and some models similar to knowledge in physics. According to this theory, sciences organize their knowledge consisting of theories, models and experiments interacting with physical situations. Perhaps, it is possible to organize knowledge of Christian theology (...) in a similar way as science (from the perspective of Christian belief). Doing this requires extensive and deep knowledge of both science and Christian theology. This paper only attempts to sketch such a theology, which is coined scientia theology to distinguish it from the existing scientific theology of McGrath. Our theology consists of a theory that is outlined here, several historical event models as well as various experiments that provide us with observations supporting the related models and principles. The theory of our theology interacts with the models which may retrodict or are supported by observations from the experiments that interact with the physical situations. (shrink)

This paper concerns model-checking of fragments and extensions of CTL* on infinite-state Presburger counter systems, where the states are vectors of integers and the transitions are determined by means of relations definable within Presburger arithmetic. In general, reachability properties of counter systems are undecidable, but we have identified a natural class of admissible counter systems (ACS) for which we show that the quantification over paths in CTL* can be simulated by quantification over tuples of natural numbers, eventually allowing translation of (...) the whole Presburger-CTL* into Presburger arithmetic, thereby enabling effective model checking. We provide evidence that our results are close to optimal with respect to the class of counter systems described above. (shrink)

Since the early days of physics, space has called for means to represent, experiment, and reason about it. Apart from physicists, the concept of space has intrigued also philosophers, mathematicians and, more recently, computer scientists. This longstanding interest has left us with a plethora of mathematical tools developed to represent and work with space. Here we take a special look at this evolution by considering the perspective of Logic. From the initial axiomatic efforts of Euclid, we revisit the major milestones (...) in the logical representation of space and investigate current trends. In doing so, we do not only consider classical logic, but we indulge ourselves with modal logics. These present themselves naturally by providing simple axiomatizations of different geometries, topologies, space-time causality, and vector spaces. (shrink)

We discuss N. I. Vavilov’s 1922 landmark publication, “The Law of Homologous Series in Variation,” and highlight its salient points. Vavilov drew upon his considerable experience in the field with wild and cultivated crop plants and summarized what he noticed in the form of a law. The law stated that comparable variant forms tended to appear in different varieties of the same species, different species of the same genus, different genera of the same family, and so on. His survey of (...) the older literature suggested that the law applied to multicellular animals as well. Vavilov acknowledged that such “parallel” series might be the outcome of convergent evolution (as conventionally understood). At the same time, by way of an alternative hypothesis, he posed a question that continues to engage evolutionary biology to this day. Namely, does the existence of such parallelisms reflect underlying structural and developmental principles (based on the laws of physics and chemistry) which constrain the range of possible plant and animal forms? The international #MeToo campaign against sexual harassment constitutes the most prominent contemporary campaign against sexual harassment worldwide. It exposed the issue by undermining the ‘culture of silence’ prevailing in several contexts, including political institutions. This article analyses one specific variant of #MeToo, the campaign MeTooEP that emerged in the European Parliament. MeTooEP is unique in many ways: it was the first collective action against sexual harassment in parliaments emerging in the #MeToo aftermath and it was the first collective action within (...) the EP led by members of the staff, which eventually drove some internal policy changes. Using a unique, large interview dataset, the analysis shows how the actors behind MeTooEP were crucial in shaping the campaign. Their knowledge of institutional rules, practices and daily presence in the EP facilitated their advocacy and transformed the Parliament into an enabling platform for their actions. With the help of Feminist Institutionalism, the analysis demonstrates how the formal and informal institutional EP bodies with their rules and regulations shaped MeTooEP in ways that constrained and empowered it. In the postwar history of the Dutch-language daily press in Belgium, the late fifties, marked by a trend!towards concentration, and the latter part of the seventies, notorious by the bankrupties of several newspapers, stand out as eras of turbulence. It is two particularly significant events occurring during the latter period, i.c. the 1976 insolvency of the prestigeous «Standaard» papers and that of «Volksgazet» two years later, which this article focuses upon. In his analysis of causes and suggested/chosen solutions, the author (...) highlights the political rather than the economic dimension of the events and their aftermaths, given that each of the failing newspapers - and -hence their survival - mattered politically, i.c. to the Christian Democrats and the Socialist party respectively. Central to this is the question of the measures considered/taken by the Belgian c.q. Flemish political authorities for having the newspapers. The course of events in each case is examined and the differences in terms of causal factors and measures taken/ omitted are noted. In the final analysis, the question arises as -to the relationship between certain political figures or groups on the one hand, and government agencies, which both «Volksgazet» and particularly the «Standaard» titles were heavily indebted to, on the other hand. In the Thirties, European personalism was an inspirational philosophical movement, with its birthplace in France, but with proponents and sympathizers in many other countries as well. Following the Second World War, Christian-Democratic politicians translated personalistic ideas into a political doctrine. Sometimes they still refer to personalism, but most often this reference is little more than a nostalgic salute. In the mainstream of Anglo-Saxon political philosophy, there are practically no references to personalistic philosophers. Is personalism exhausted as a philosophy or political (...) ideology? Yes and no. Paul Ricoeur, writing in Esprit , summed up the situation like this: “personalism is dead”, but he was careful to mention a “return of the person”. Indeed, no tradition or movement can simply perpetuate itself. It must, in order to continue making history, always abolish itself as a `system' so as to make room for the unsaid and the unthought in its tradition, an idea that Mounier also fervently believed in.To better situate the current discussion of personalism, however, it is necessary to look back to the original characteristics of personalism in the Thirties. As a response to the crisis provoked by the economic depression, failing democracy and existential uncertainty, there arose in France a number of `non-conformist movements' who labelled themselves personalistic. They did not constitute a unified movement with a commonly shared theory. It was rather a collection of `personalisms'. The article by the historian Christian Roy about the ecological personalism of Bernard Charbonneau and Jacques Ellul sheds interesting light on the multiple origins of French personalism, which is all too easily identified with the work of Maritain and Mounier alone. The work of Jacques Maritain, and the network of writers and artists surrounding him, undoubtedly remains a significant historical reference point when speaking of personalism.Another group was formed around Alexandre Marc who, along with Raymond Aron, Arnaud Dandieu, Daniel-Rops and Denis de Rougemont, kept the journal Ordre Nouveau alive for five years . They elaborated the idea of federalism as a way out of liberalism and totalitarianism. The most important and durable group, however, was formed by the movement and journal Esprit, founded in 1932 by Emmanuel Mounier and George Izard. In order to stress the historical importance of Esprit, we are including here a testimony from 1982, written by Paulette Mounier, the founder's wife, in which she looks back on 50 years of Esprit. After the war, some new and related groups formed, such as Economy and Humanism around Louis-Joseph Lebret. An historical survey of the dissemination of personalistic centres and movements, not only in France but over all of Europe, would be material for a stimulating historical research project. In this issue, there will also be mention of, among others, the Prague personalism of Jan Patocka and Vaclav Havel, the Leuven personalism of Louis Janssens, and the Polish personalism of Tadeusz Mazowiecki and others. But this list is far from exhaustive.What unites these various branches of the personalistic tree? It is a certain conception — or better perhaps: a certain attitude to the human person. Personalists were not seeking in the first instance a new academic theory about the person, but rather a practical philosophy of engagement. In the Thirties, quite a few personalists finished their university studies and chose not for an academic career but for non-conformist, demanding and vulnerable commitments with limited financial means. What motivated them? Primarily a strong sense that the time in which they were living was a turning point, one which was being ignored by the academic world. They interpreted the diverse economic, political and cultural crisis phenomena as symptoms of a more global crisis of civilization which demanded a response through radical change.Hence a certain rhetoric of a `new order', `spiritual revolution', `radical reform' and `rebirth'. But the rhetoric was supported by innovative ideas regarding political federalism, the third way economy and human alienation. The motivation for all this derived from a strong commitment to defend the concrete human person against the arrogance of systems, bureaucracies and ideologies, while at the same time avoiding the pitfalls of individualism — the reason why some personalists always qualified personalism as `communitarian'.In fact, much of what presents itself as communitarian philosophy today is a retrieval of personalistic themes from the Thirties applied to the current situation, a situation which is also interpreted by communitarians as a global cultural crisis. One should not forget, however, that alongside and sometimes opposed to the communitarian theme with its call to bring people back to their communitarian roots, personalists underscored the priority of metaphysics over politics, a theme that can likewise be found in the writings of personalistic dissidents in Eastern Europe. In the words of Mounier in Qu'est-ce que le personnalisme : “personalism combines faith in a certain human absolute with a progressive historical experience”.To what extent is personalistic thinking still relevant today? Its current relevance will be examined in three ways. In the first section, a number of articles are presented which illustrate the active presence of personalistic thought in the domains of politics and applied ethics. Vaclav Havel sent one of his recent addresses in which he links the theme of human rights with that of a world spirituality. His article is preceded by an introduction by Guido Van Heeswijck, situating Prague personalism.The need for an orientational philosophy of the person is not only manifest today in the political arena. Developments in economics, ecology, health care, the media, technology and in the world of the professions have had an extraordinarily large impact on the human person's lifeworld. The whole area of applied ethics requires a dynamic and orientational concept of the person. The contributions by Paul Schotsmans and Luk Bouckaert are seeking a personalistic point of departure for applied ethics. The more historical article by Christian Roy on ecological personalism has been included in the first section because it can be inspiring for an environmental ethics.The second section is more philosophical. To what extent does the `personalistic' conception of the person put forward in the Thirties still have any relevance today, following the waves of structuralism, post-structuralism and postmodernism? Paul Ricoeur's article, Approaching the Human Person — originally published in Esprit in 1990 and now translated for the first time — can be seen as a reference text. Ricoeur shows in what sense the concept of the person must be broadened in order to continue functioning. The person as `narrative identity' can only write history through the medium of language and institutions. Starting from very different assumptions, the articles by Louis Janssens & Joseph Selling and the analysis of Roland Breeur also explore the idea that a person is what he is only when his identity is opened up, touched by an exteriority or conceived as a focal point . It is this radical openness and vulnerability that gives the person its historical and transcendent dynamic, and prevents us from encapsulating it in existing systems, theories and power relations. The connection with Emmanuel Levinas and his hermeneutic of the idea of the infinite is an obvious one to draw.The third section contains a historical survey in which a number of active `personalistic' centres and journals are presented.Various European centres that appeal explicitly to some form of personalistic thinking were posed the following questions: What is the main historical reference to personalism at your centre? and How do you implement, today, a personalist credo in your work? John Dick organized the responses to these questions under a number of headings. This survey aims to provide not so much an exhaustive but a representative picture of the ways in which European personalism lives on as a mosaic of centres engaged in everyday history. (shrink)

Etica este interesantă cu precădere atunci când pune în joc intuiții morale sau valori diferite și când ne confruntăm cu dileme în care decizia nu este evidentă, iar dezacordul este rezonabil. Prin urmare, am încercat să ne ferim pe cât a fost posibil de verdicte și de simpla enumerare a unor interdicții. Veți observa că, de cele mai multe ori, exercițiile (...) și temele de discuție nu au soluții impuse. Nu pentru că autorii manualului nu ar adera la anumite soluții (poate nu la aceleași!), ci pentru că ni s-a părut mult mai importantă conturarea problemelor. Separate individual's disposition to take action does certainly not constitute a sufficient condition to engage in demonstrations. Doubtlessly, equal importance is due to organisational and institutional factors in society, and the individual's position in those. Ultimately, a demonstration is the result of a struggle between organizations for going control over individuals in order to support or defend their own objectives.In the mobilization process these organizations may make use of a diversity of mechanisms and techniques to control or to influence their (...) members, as there are : the exploitation of the affective and instrumental ties binding the individual to the organization ; the access to - and the use of - the mass-media ; the use of selective communication by the organizational leaders and the induction of frustration. Special attention is given to the role of the militant and the characteristics of his language in the mobilization proces. (shrink)

In this article an analysis is made of the voting behaviour of Members of Parliament and political parties after the parliamentary debate on the investiture of a new cabinet. The voting behaviour does differ from the classical coalition-opposition voting pattern. Indeed the emerging general pattern shows that a majorityof the members of the coalition parties - but by no means all of them - approve the governments' declaration and that a majority of the members of the opposition rejects it.Deviant voting (...) behaviour after this parliamentary debate is not a general phenomenon and mostly only some majority members vote contrary to their whip's instructions. This dissident stand is taken mainly when cabinets can rely on a broad parliamentary majority. This deviant voting seems to be positively correlated to the size of the coalition.The directly elected Members of Parliament most easily vote in an unorthodox manner. The individual Members of Parliament motivate their deviant vote referring to the opinion of their electorate. (shrink)
